Thomas v. State, 550 So. 2d 1057 (1989) Alyce L. Guice

Mrs. Alyce Thomas, lives in Gadsden, Alabama. She is now 90 years old and Dr. Dorothy spoke with her about her arrest over 33 years ago. And, like Dr. Dorothy,  she was arrested for not knowing the whereabouts of her, then, 17-year-old son, Steve Thomas. Mrs. Thomas, a civil rights activist, a mother, a grandmother, and a fierce freedom fighter, spent time in jail because the judge, like judge Kramer overstepped his authority by placing Mrs. Thomas, in jail.

Mrs. Thomas, much like Dr. Dorothy, was confined to an Alabama jail, without a bond, without reason, without cause, without merit, and without legal standing for almost three months. A Los Angeles Times article from August 13, 1989 addressed Mrs. Thomas woes, stating, "... There was, for example, the Gadsden Police Department’s dubious history of abusive behavior. There was the suggestion of a particular police vendetta against O. M.'s family--both O. M.'s father and uncle had died while in close proximity to officers of the law, the father in a hail of bullets while fleeing a routine traffic stop in 1978, the uncle at the end of a rope swinging from a county jail shower head in 1984, in what was deemed a suicide.

Finally, there was Alabama’s historic willingness to execute young people--11 have died in the state’s electric chair for crimes committed as juveniles. All were black. O. M. is black....". Ollis Madden or O.M. was Alyce Thomas' 17-year-old grandson who had to leave Alabama to remain alive in an attempt to not end up as his relatives had ended up. Mrs. Thomas was arrested while her 17-year-old son, Steve went missing after Mrs. Thomas and her husband took him to the Gadsden, Alabama police station. However, the parents were told to take the teen back home with them.

Not too long afterwards, Steve's mom, Alyce Thomas was held in contempt of court on June 2, 1988. It speaks for itself that many under-represented families are being targeted for destruction in America. Families are the foundations of America's strength. Few people are brave enough to stand up against the evil tricks of such genetically defective demons who have the goal of stealing innocent children that they did not give birth to.

On the same note, however, Melanated (Black) females in America, have always been under attack especially when it comes to being treated as humans. For example, Mary Hattie Graham Turner, in May of 1918, being eight months pregnant was lynched in Lowndes County, Georgia for speaking out against the hanging of her husband. the day before. Mrs. Turner was taken from her home by several demonic souls with her ankles tied as she hung upside down from a tree.

Mrs. Turner was then doused in gasoline and burned. As she lived on, her baby was sliced from her stomach, and stomped to death. The remainder of her body was shot beyond recognition after that. Although this unbelievable act of cowardness did not take place in Alabama, the point is that all over the country, Melanated females have had to endure shaming of all kinds by Americans as well as by the American government.

America must no longer allow skin tone to rule over us because innocent lives are at stake. This is particularly true when many Melanated mothers to be die while pregnant at a rate of 300 % more than Melanate deficient mothers to be. These facts were published by the CDC. Women, in particular, are especially ill treatment by a judicial system that has maintained a pattern of unwarranted hate against Melanated people, in general.

Injustice, unfairness, and inequality against women, in general, must no longer be tolerated. Malcolm X stated that, "The black woman is the most unprotected species in America". To add insult to injury, grandparents, both Melanated and Melanate deficient, are more likely to face obstacles in having their grandchildren handed over to them than strangers face when a court orders the grandchildren to be temporary housed away from their parents.

In a May 22, 2019, "3 On Your Side Investigates" news article, titled, "Grandparents face more restrictions than rights when it comes to protecting their grandchildren", made it clear that the courts, along with the Department of Human Resources (DHR), often get their custodial decisions twisted to the detriment of the children under the wondering eyes of twisted government agencies like Shelby County Department of Human Resources (SCA DHR). For example, Shelby County, Alabama DHR (SCA DHR) neglected to give custody of a toddler to his grandparents although the SCA DHR workers knew that the mother of the toddler, Sommer Nicole Wilford, was an unfit parent.

The article, titled, "Woman charged in toddler's death in fiery crash wants charge reduced to manslaughter ", from March 06, 2019, made it clear just how the SCA DHR seemingly, on purpose, makes bad custodial decisions as in the case of Dr. Dorothy. Dr. Dorothy was disallowed from taking care of her grandchildren when Dr. Dorothy had provided the SCA DHR court credible testimony that she is more than fit to be a custodian for any child, especially her grandchildren.

In another article, titled, "Grandma of toddler killed in car fire sues DHR workers for returning him to 'drug-abuser' mom", dated, Dec. 18, 2015, shows just how willing the SCA DHR workers are in granting  custody to grandparents when the parents are unfit even when the grandparents are better suited to care for the children. However, in the case of Dr. Dorothy, the parents of her grandchildren were hard-working, law-abiding citizens who took pride in their children, who home-schooled their children daily, and who abided by the unjust orders of biased Judge Kramer, to the letter of the law just so they could regain custody of their children who were taken from them without a legal standing, without notice, without a hearing, without jurisdiction, without reason, and surely without legal cause of any kind.

Judge Kramer is a well-known bully and is hated as well as greatly feared among his peers to the point of many lawyers refusing to go near his courtroom. He along with his Attorney friend, Guardian Ad Litem (GAL) Jill Tarte Karle, and their array of diabolical clerks like Melanie Easterling, conspire to steal as many children as possible in an attempt to satisfy their corrupt judicial system demands. These people simply love stealing children from innocent parents.

They also love letting precious children remain with parents who are rotten apples so that the children can end up dead. Another example of such corruption in the Alabama courts was when a Gadsden, Alabama juvenile court held that the previously mentioned Civil Rights Activist, Alyce Thomas, was in contempt of court for her inability to know the whereabouts of her son. Civil Rights Activist Alyce Thomas is still fighting for justice for all. She is another Melanated female who maintained that she did not know the whereabouts of her son just as Dr. Dorothy has maintained all the while that she does not know the whereabouts of her grandchildren.

How could Dr. Dorothy know the whereabouts of her grandchildren when Judge Kramer never even had the courtesy or grace to grant Dr. Dorothy legal custody or guardianship of her own grandchildren? Instead, he granted temporary custody to the paternal grandparents, who had difficulty rearing their own six children, and who just happen to be Melanate deficient. Further, Dr. Dorothy, in not knowing the whereabouts of her precious grandchildren, was promised by Judge James Kramer, who may, even now, have his Bar license suspended, that she would not be arrested if she went against her Fifth Amendment rights, and answered his questions. Dr. Dorothy truthfully answered his questions to the best of her ability, and Judge Kramer still viciously had her arrested after threatening her First Amendment rights by saying, "... I wouldn't say anything else...".

Yet, Dr. Dorothy broke out in praise to JESUS, WHO must be praised even when the enemy seems to prevail for a short while. Hypothetically speaking, even if Judge Kramer felt that Dr. Dorothy knew the whereabouts of her grandchildren, wouldn't it have been reasonable to assume that she still knows the whereabouts of them after being bound in jail for 49 days? And, wouldn't this be that much more applicable when Dr. Dorothy had to endure hearing the "N" word used continuously while housed at the SCA jail, endure other inmates inappropriately talk about wanting to touch her bottom, and endure constant speech fights when she spoke out against the "N" word being used?

Moreover, Dr. Dorothy was placed in solitary confinement because Melanie Easterling, the before mentioned SCA Clerk, who is a pathological liar, called the SCA jail and concocted a story that Dr. Dorothy called and harassed her when the SCA court system has barred calls from the jail? Yet, the jailer told Dr. Dorothy that since Easterling was a part of the SCA court system, that he had to take action with her being one of Judge Kramer's employees. But, are not all calls monitored and recorded at the Shelby County, Alabama Jail? Of course, they are.

And, even the jail authorities knew she lied, and nothing was done against her. In recent years, implicit ethnic bias and harmful attacks on the family have led to adjunct inequality in judicial decision-making. This has become self-evident all around the nation. However, in Alabama, judges like Judge James Kramer demonstrate unbridled discrimination in granting custody and guardianship of beautiful children to people who are not nicest, who have criminal history, and whose goal is to destroy children. Dr. Dorothy's grandchildren were forced by Judge James Kramer to stay with their father's parents, who, for no reasonable understanding, decided that they would no longer keep the children, out of spite. For instance, the paternal grandparents of Dr. Dorothy's grandchildren, LL and RLT, are the ones who Judge James Kramer continues to have ex parte conversations with, and who never attended one hearing that was mandatory.

Subsequently, they were never arrested for violating Judge Kramer's order to be in attendance for a 11/8/22 hearing as well as a 11/15/22 hearing. One must ponder as to why weren't LL and RJL also incarcerated for failure to disclose the children's whereabouts when they were granted temporary custody of the grandchildren of Dr. Dorothy? Judge Kramer granted LL and RJL custody and guardianship over the toddlers. Thus, why weren't they put in jail for contempt when they were ordered to attend a mandatory hearing, twice, and never showed, and when they, too, have stated they do not know the children's whereabouts? Further, in Thomas v. the State of Alabama (550 So. 2d 1057 1989), the Supreme Court of Alabama declared that the juvenile court has no jurisdiction to hold someone in contempt of court for failure to disclose the whereabouts of a child. The Supreme Court of Alabama ruled that the juvenile court had no authority or jurisdiction to order Mrs. Thomas' arrest, find her in contempt, and order her incarceration.

Why did the judges in SCA Circuit court fail Dr. Dorothy in neglecting to recluse themselves as they promised to do? Why did this happen to Dr. Dorothy and her family when the Supreme Court of Alabama already concluded that a person cannot be held in contempt for not knowing an answer and this is exactly what Judge Kramer (lower court/juvenile court) placed Dr. Dorothy in Contempt of Court over, and incarcerated her for? This is a complete violation of the law on Judge Kramer's part, and he knows it. At an in jail Zoom hearing, Judge James Kramer promised to have a hearing that he neglected to have,"... after the children are brought back...".

This promise was also a lie. Please help us fight these clear violations of Dr. Dorothy's rights as a grandparent, as a human, as a civil rights activist, and as a child of GOD. Her arrest and subsequent abuse by Judge James Kramer will go on until eternity if he has his way. Moreover, it is also wrong for Judge James Kramer to wreak havoc on this elderly Melanated disabled Veteran, doctor, retired English teacher, and pastor. His abuse has not ended, and will not end until a just judicial authority takes notice.

Thus, it is a clear exploitation of power as well as authority for Judge James Kramer to employ his position of power over Dr. Dorothy, and over unlawfully jailed SCA children. It is reprehensible for these children, who have done nothing wrong, and who have already been torn from their loving families to be forced to spend many lonely, sleepless, condemning nights in stone-cold jail cells that were never meant for babies to start with. The evil reign of Judge James Kramer has gone on long enough. It’s time for Judge James Kramer along with his debase followers to spend some time behind bars for intentionally punishing American citizens who have committed no wrongful acts.
